February 2009, Georgia
While many people have the misconception that personal injury lawsuits are all about recovering money, sometimes the most important result for a family is to find out the truth. In February of this year we were recruited by the family of an elderly nursing home resident who had suffered a number of suspicious injuries. Attorneys for the nursing home had attempted multiple times to deny us access to meet with a fellow resident who witnessed the abuse suffered by our client’s loved one. Without accepting any legal fees from our clients, we petitioned the court for a Temporary Restraining Order, and we were successful. This is just one of numerous occasions in which we have taken this type of aggressive action for our clients. It is an example of our dedication to securing justice, no matter what path we have to take to achieve it.
Result: The court rejects the nursing home’s attempts to bar our access,
specifically authorizing us to interview the witness and discover the truth of
the accusations of abuse.
March 2009, Georgia
Our client’s family member, a 63 year-old man, died while recovering from major heart surgery at a skilled nursing facility. We discovered through the course of our investigation that nurses and staff members ignored his pleas for help and for supplemental oxygen to help him breathe. His body, weakened by the trauma of the surgery, could not handle the added stress of inadequate oxygen. Our investigation proved that the facility was understaffed and there was evidence the patient’s chart had been falsified in an attempt to cover up wrongdoing.
Settlement: $275,000
April 2009, Tennessee
We were retained by the family of 78 year-old woman dependent on a feeding tube for nutrition and confined to a nursing home. The nursing staff failed to follow the physician’s orders about the proper handling of the patient’s feeding tube. Our client’s loved one sickened and died in the presence of facility staff when the feeding tube began to back up. Tragically, this patient’s caretakers refused to call an ambulance for emergency assistance, partly because she “got on their nerves.”
Settlement: $750,000
